Khoodeelaar! constitutional law No to "Crossrail Bill" court actions against UK Ministers - update at 2105 Hrs GMT London Monday 7 July 2008
Grounds
Parties as defendants
date or dates of actual applications
As stated on dozens of occasions before in our previous updates, legal action will only begin when all procedural pre-action stages have been comprehensively and definitely covered.
Grounds are as published daily on the KHOODEELAAR! campaign web sites and the items and updates published in support of KHOODEELAAR! by AADHIKARonline 24/7.
Those grounds also constitute evidence in a number of cases. They run to more than 100 separate listed items. Some of the ones that we have stated before and which are at the centre of our constitutional law challenge to the UK Govt include the following:-
The central grounds include the fact that Ministers have lied in parliament and in and to the public. They have also BREACHED the UK’s constitutional obligations and treaty obligations. This list includes the false and the misleading statement made by the then Transport Minister in Tony Blair’s cabinet, Alistair darling about the Crossrail Bill being compatible with the the European Convention for the Protection of Human Rights and Fundamental Freedoms [ECHR].
What legal avenue shall we go down
There are several. But the current programme is the human rights route. We shall invoke the necessary provisions to show that the Houses of Commons and Lords ‘select committee’s have failed to look for or hear evidence that would have proven that the Crossrail Bill was far too irrelevant to the purpose. That it was far too wasteful and diversionary. And damaging to the people and the communities affected by it.
A ‘local’, procedural device that we shall apply on this is the UK’s ‘Human Rights Act’ 1998. That Act falls a long way short of the ECHR but it can be applied to demonstrate the tendency of antihuman rights conduct by the UK Govt.
The same allegation of lying applies against the others who have made any decision about, for or in support of Crossrail whilst they have held positions to make law-allowed decisions to spend public money or resource to promote Crossrail
The same applies against councillors in Tower Hamlets who have lied and or made false statements about their role, about the role of the Council and about the decisions that they have made or in effective approved of to apply public resource or money to back Crossrail
The total number of parties and defendants is yet to be finalised. At the time of writing, there are 20 individual defendants and 10 corporate defendants.
The date or dates will be decided once the current ‘parliamentary procedures’ have been finally completed and we are clear as to what can be alleged against the UK Govt on the EVIDENCE of their conduct. The UK Govt which has acted as the promoter of the crass measure. In the two Houses of Parliament the UK Govt in this has been fronted by the UK Department for Transport so far.

Will the Crossrail hole plot-'lured' Gordon Brown now see sense and scrap Crossrail?

Or perhaps Gordon Brown may be privately 'relieved' that Peter Kellner's outfit has at last produced the way out for him... Way out of the bogus commitment to fund the CRASSrail scam from the public sources....
Funds that are so seriously scarce now that Brown is having to make a historic plea to people in the UK not to waste food!
And to hear Brown;s voice being produced in that unsettlingly contradictory tone of
the former Viscount STANSGATE as played by his son Hillary Benn today was indeed uncanny....
A Benn pleading to people in Britain not to waste food... Not to throw away food that is fit to eat...
Whatever had been happening to society for 11 years when so much food had been, must have been thrown way...?
What morality, what ethics, what sense is it that makes otherwise ‘okay’ people to commit such callous acts...
Could the callousness be linked with the callousness, the irresponsibility and the lack of care about the world that has been engendered by a callously opportunistic corrupting Government that has lied on so many issues and topics and scams... Like CRASSrail?
CRASSNESS in Parliament. Crass behaviour by people who practically worship the situation of Parliament...
Suddenly,,, the world class capital city - phrases that only a few weeks ago were being uttered by the egotistic Ken Livingstone and his entourage, sound very hollow....
How times change...
And we are saying to Gordon Brown that he must scrap the CRASS scam and instead focus attention, as far as the use of public resources for meeting the transport needs of London are concerned to sound solutions.
Crossrail is a CRASS response to a serious transport situation. A serious economic,ic problem.
We have examined ALL the elements and factors in the past 56 months and we shall continue to do so.
That ANYONE other than the Khoodeelaar! movement against CRASSrail, can say that Crossrail is less important than any other project, scheme or scam is in itself news...
Not that they should not say this.
But that for 56 months they have been in denial and they have been pretending otherwise...
We have said that the economic criteria are not met by Crossrail. that there is no demand in the economy for such scam.
That there is no demand in areas like the parts that the planned line touches, for it.
There have been surrogate supplicatory plugs of course. Like in Greenwich and other places to the west of London.
In Greenwich, a very corrupt clique in control of the local Blairing Council has been quite similar in its role for plugging Crossrail to that found in Tower Hamlets. The Greenwich Council clique is as corrupt as its counterpart in Tower Hamlets. Elsewhere in London, no other local council has behaved so brazenly or so stupidly in plugging for Crassrail Individual, Blairing careerists have behaved as irrationally as some time-servers we have identified and exposed in tower Hamlets. But in the main, even the Blair-backing local councils have stayed silent. And the then Tory party Chair Francis maude made the open criticism [April 2006] of Crossrail hole plot, although he the repeated the Party position on Crossrail overall. But there has been no evidence from their Transport spokesman for ages. As there has been none from the Lib Deems.
Which shows that even THEY have seen sense or the evidence. that there is no demand or need for Crossrail in the tottering uk macro economy
And what does the deputy governor at the ~Bank of England say about the state of the economy?
Not very hopeful, is he, the Professor?
Even he says that the UK economy has got to be more productive...
Productivity surely cannot be associated with the crass waste of £Billions on project that has only one certain winner: Big Business construction outfits.
The main areas that are supposed to deserved by the crassly conceived plan has no demand for that line.
There are other demands for other needs and services on transport in London. But not for Crossrail.
We shall examine the pollster-found businesses-preferred Thames G...way itself in due course.
The YOUGOV poll finding should again shown to Gordon Brown and all in the UK Treasury now, that Ken Livingstone was wrong to peddle for the Big Business agenda... That Gordon Brown was tricked into making that commitment for public funding of Crassrail to the tune of £Billions...

Before making ANY further 'new' 'announcement', Boris Johnson has got to find a simple sober chair. Sit on it. Or in the chair. Reflect. Then think. Reflect again.
This need not take more than a day or so.
Then he should take stock of what he has done.
What he has overlooked.
He has forgotten London already by the sounds of things!
What he has prioritised.
He has prioritised nothing that really matters to London by the looks of things.
Are they all in order?
Boris is getting way out of order.
And how many ‘colourful’ excuses he can find before he has to say goodbye to the Onion!
The speed with which he has 'allowed' two of his 'hoisted' 'advisers' and 'deputies' to ‘resign’ has been undue.
And the speed of the announcement of the inquiry into Ray Lewis “allegations” and the announcement scrapping that same inquiry within 100 hours is undue.
Whatever the 'mainstream' media have been saying about Boris Johnson being the flagship for a supposedly future Tory UK Govt, must be based on a fabrication.
Boris Johnson needs to get to work. "Flat out'.
He has not done so. Not yet.
Making the announcement of a competition on the new Routemaster Bus is not really serious work.
To get to work as opposed to getting on the media in positive lights means he must part company with the media.
It may not be easy. The media has made Boris what he is. Or what he is soon not going to be!
And that means he has got to leave the company of the media.
He needs to ration the output.
Nobody needs to know about his every move. It will amount to nothing.
And before he accepts anyone as his ‘deputy’ or equivalent again, he has to remember certain things.
That he was 'sacked' by Michael Howard in effect.
For lying.
For a string of sexual encounters outside of his own marriage...
And then he has to remember that in Steve Norris, he has got a single individual with the undeniable capacity of carrying several adulterous partners all at the same time.....
Has Boris thought of sacking Norris too. From whatever role he has given Norris so far?
Logic says - and sense says - that Norris should never have been taken on board by Boris....
Or am I here sensing an atmosphere suggesting that a news item or two around Steve Norris is about to come our way?
BEST thing would be to sack Steve Norris now.... And be done with whatever it is that Norris has been peddling. Including Crossrail....
